Terms and Conditions

These Terms govern your use of BribieNow. They preserve your non-excludable rights under the Australian Consumer Law and are governed by the laws of Queensland.Effective: 25 May 2026Last updated: 25 May 2026

1. About these terms

These Terms and Conditions (Terms) govern your access to and use of the BribieNow website at https://bribienow.com.au and any related services (the Service). They form a binding agreement between you and [Full legal name], a sole trader based in Queensland, Australia (ABN [XX XXX XXX XXX]) trading as BribieNow (BribieNow, we, us, our).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. About BribieNow

BribieNow is a free, community-focused local dashboard for Bribie Island. It provides conditions information (weather, tides, marine and traffic), an events calendar, a directory of local businesses and tradespeople, community submissions (garage sales, missing pets), and locally-curated guides.

BribieNow is operated by a single sole trader. It is not a government service, an emergency service, or a marine-safety service.

3. Eligibility and accounts

You may use the public, read-only parts of the Service without an account. To submit content, save items or use account features, you must:

  • Be at least 16 years old (or have permission from a parent or guardian);
  • Provide accurate information and keep it up to date;
  • Keep your sign-in credentials confidential, you are responsible for activity on your account; and
  • Notify us promptly at privacy@bribienow.com.au if you suspect unauthorised use of your account.

We may suspend or terminate accounts that breach these Terms, that we reasonably believe are being used to abuse the Service, or that have been inactive for an extended period.

4. User-submitted content

When you submit content to the Service, an event, garage sale, business listing, missing-pet listing, pet sighting, comment, photo or any other material (User Content), you remain the owner of that content. However:

  • You grant BribieNow a non-exclusive, royalty-free, worldwide licence to host, display, reformat, store, back up and distribute that User Content on and through the Service (including in social previews, search-engine snippets and email notifications) for as long as you keep it on the Service.
  • You confirm that you own the User Content or have all rights necessary to grant the licence above, that the User Content is accurate to the best of your knowledge, and that it does not infringe any third party’s intellectual property, privacy or other rights.
  • You must not submit content that is unlawful, defamatory, misleading, harassing, hateful, scam-related, sexually explicit, or that depicts or promotes illegal activity.
  • You must not submit personal information about other people without their consent (for example, a friend’s phone number in a public listing).

We may moderate, edit, decline or remove any User Content at our discretion, particularly if it breaches these Terms, applicable law, or our community standards. We do not pre-screen all User Content and we are not responsible for User Content. If you believe User Content on the Service is unlawful or infringes your rights, contact privacy@bribienow.com.au.

5. Acceptable use

You must not:

  • Use the Service for any unlawful purpose or in breach of any applicable Australian law.
  • Probe, scan, attack or interfere with the Service, including circumventing rate limits, authentication or security controls.
  • Use automated tools (scrapers, bots, crawlers) to access the Service beyond what robots.txt permits.
  • Misuse contact, address or location information shown on the Service, including not approaching, harassing or trespassing on a person or property because of a listing.
  • Impersonate another person or misrepresent your affiliation with any individual or organisation.

6. Business directory and tradespeople listings

The directory and tradespeople sections include both listings created by businesses themselves and listings curated by BribieNow. Where a listing displays a verification or licence badge, the badge reflects information available to us at the time and is not a guarantee of current licence or insurance status. Always confirm credentials directly with the business, and check the relevant Queensland regulator (for example, the Queensland Building and Construction Commission) before engaging a tradesperson.

BribieNow is not a party to any arrangement you make with a business or tradesperson listed in the directory. Any dealings, contracts or disputes are between you and the relevant business.

7. Events, garage sales and missing pets

  • Events. Event information may come from organisers, ticketing partners or our own curation. Dates, times, prices and availability can change. Confirm details with the event organiser before relying on them.
  • Garage sales. Public listings show only the suburb and the public address the submitter chose to share. Do not arrive outside the listed hours, trespass on private property, or contact the seller outside the channels they provide.
  • Missing pets. Missing-pet listings rely on information provided by the submitter. Sightings are also user-generated. Treat them as leads, not as confirmed facts.

8. Conditions information, important safety note

The conditions surfaces (weather, tides, marine, swell, traffic and bridge route times) are provided for general information only. They are derived from third-party data sources (such as WillyWeather and Mapbox) and may be inaccurate, incomplete, delayed or unavailable.

  • Do not rely on BribieNow for decisions that affect safety of life or property.
  • For official weather warnings, refer to the Bureau of Meteorology (bom.gov.au).
  • For marine and boating safety, refer to Maritime Safety Queensland and Australian Volunteer Coast Guard sources.
  • Bridge travel-time estimates are best-guess route comparisons, not a promise about how long your crossing will take.

You use this information at your own risk.

9. Intellectual property

The Service, including all source code, designs, layouts, text, graphics, logos, and aggregated/curated content, is owned by or licensed to BribieNow and is protected by Australian and international intellectual property laws. You may view and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of any part of the Service except with our prior written consent, or where permitted by the Copyright Act 1968 (Cth).

User Content remains owned by the user that submitted it, see clause 4.

10. Third-party links and services

The Service contains links to third-party websites and services, including event ticket pages, business websites, and weather provider sources. Those sites are operated by third parties and BribieNow has no control over them. Following a link is your decision and your risk, and any dealings you have with the third party are between you and the third party.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee, warranty or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or under any other law that cannot lawfully be excluded.

To the extent the ACL applies to a service supplied by us, and the supply is not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for any breach of a non-excludable guarantee is limited (at our option) to:

  • supplying the service again; or
  • paying the cost of having the service supplied again.

13. Disclaimers

Subject to clause 12, the Service is provided “as is” and “as available”. We do not warrant that:

  • The Service will be uninterrupted, secure or error-free.
  • Information on the Service (including conditions data, event details, business details and user submissions) is accurate, complete or current.
  • The Service is fit for any particular purpose.

You acknowledge that BribieNow relies on third-party data feeds that may fail, change or become unavailable, and on user submissions that we do not independently verify.

14. Limitation of liability

Subject to clause 12, to the maximum extent permitted by law:

  • We exclude liability for loss of profit, loss of revenue, loss of business, loss of data, or any indirect, incidental, special or consequential loss arising out of or in connection with the Service.
  • Our total aggregate liability to you arising out of or in connection with the Service is limited to AU$100.

Nothing in these Terms limits liability that cannot be limited or excluded by law, including liability for personal injury caused by our negligence, or liability under the ACL non-excludable guarantees.

15. Indemnity

To the extent permitted by law, you agree to indemnify BribieNow against any third-party claim, loss, liability or expense (including reasonable legal costs) arising out of:

  • your User Content;
  • your breach of these Terms; or
  • your use of the Service in breach of any applicable law.

16. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service (in whole or in part) at any time if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose us to legal or operational risk.

Clauses that by their nature should survive termination, including clauses 4, 9, 12, 13, 14, 15 and 17, will continue to apply after termination.

17. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. You and BribieNow submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising out of or in connection with these Terms or the Service.

Before starting court proceedings, we ask that you contact us at privacy@bribienow.com.au so we can try to resolve the dispute informally.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes will be highlighted on the website. If you keep using the Service after a change, you are taken to have accepted the updated Terms.

19. General

  • Severability: If any clause of these Terms is found to be invalid or unenforceable, the rest of the Terms continues in force.
  • No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You cannot assign or transfer your rights under these Terms without our consent. We may assign these Terms (for example, if BribieNow is restructured into a company).
  • Entire agreement: These Terms together with the Privacy Policy form the entire agreement between you and us about the Service.

20. Contact

These Terms are a general framework drafted to comply with Australian Consumer Law and to protect BribieNow as a free community service. They do not constitute legal advice. Before launching commercially, introducing paid features, or relying on these Terms in any dispute, have them reviewed by an Australian lawyer.
